A federal district court judge has ruled in favor of environmentalists' claim that EPA must take public notice and comment on its determination that it has satisfied a Clean Air Act mandate to regulate 90 percent of certain air toxics, though the judge declined to address the merits of whether the agency's determination is legally sound. The July 25 order by U.S. District Court for the District of Columbia Judge Paul Friedman means that environmentalists and EPA will now have to tell the court suggested timelines for EPA to re-issue its air toxics finding and open it to public comment. The groups involved in the suit have until Aug. 15 to reach an agreement on a comment schedule, or to propose competing schedules that the court would then use in setting its own timeline.
