EPA standards for emissions from municipal waste combustors and a vacated rule governing mercury releases from power plants provide precedents to help EPA justify its proposed greenhouse gas (GHG) standards for exiting power plants, one environmentalist says, including its controversial effort to set targets based on reductions achieved beyond a facility's fence line. However, an industry lawyer says broad approaches can only be used for compliance, not for setting standards. How broadly EPA can interpret a requirement in section 111 (d) of the Clean Air Act to determine the "best system of emission reduction" (BSER) will be a key legal question in future suits over EPA's proposed utility existing source performance standards (ESPS).
