EPA plans to soon require brownfields grant applicants to consider how a proposed cleanup remedy will withstand climate change impacts such as sea-level rise, is prompting concern among some lawyers who question the technical burden it may place on grant applicants and whether it will curb interest in some development projects. It is "way too early" to allow environmental consultants and contractors "to charge premiums" for unproven strategies for determining resiliency to climate change, says one environmental lawyer. "There are environmental professionals who are skeptical at best" over the upcoming requirement, the lawyer adds.
