Industry and other EPA critics say they are planning a new strategy to block the agency's controversial pending guidance for determining when isolated wetlands and other marginal waters are subject to federal regulation under the Clean Water Act (CWA), but they acknowledge they face limited prospects. "The goose is cooked and we're just going to have to eat it," one industry source says. "Industry is still very much willing to fight a rulemaking ... but having the changes pushed through in a guidance is difficult," adds one Republican source, but "options [for blocking it] are fairly limited." While Sen. Rand Paul (R-KY) has recently introduced legislation, S. 2122, that would amend the water law to make EPA's planned approaches unlawful, the industry source says opponents of the upcoming guidance are now planning a narrower approach aimed at "[stopping] the guidance."
