Industry and environmental groups are criticizing a host of provisions in EPA's revised package of emission rules for boilers and incinerators, with industry arguing the rules are too strict and unachievable while activists question the legality of the changes - suggesting the rule package could ultimately face a fresh round of lawsuits. EPA's revised rules are an attempt by the agency to address industry concerns that the combustion rules as originally issued in April were largely impossible to meet and based on faulty data. EPA initiated a rare self-initiated stay of the rules while it reconsidered them in line with industry's criticisms. The agency subsequently issued proposed revisions to the rules Dec. 2, but comments just filed on the regulations show that the changes are drawing attacks from all sides.
