EPA is struggling with whether it can grant flexible greenhouse gas (GHG) "plantwide" applicability limits (PALs) allowing facilities to make modifications without triggering GHG control mandates if the changes do not exceed a plantwide GHG cap, deferring industry requests for PALs while EPA assesses its authority for issuing them. The Semiconductor Industry Association (SIA) asked EPA in a July letter to allow GHG PALs for its industry, whose facilities generally qualify as minor sources for all other regulated pollutants except GHGs. A PAL would allow a semiconductor manufacturer to avoid best available control technology (BACT) for GHGs entirely. EPA's "tailoring" rule establishing GHG permitting thresholds requires permits to include BACT for GHGs emitted over certain thresholds.
