A pair of Iowa residents who participated in a large nuisance suit over allegedly noxious odors from a hog farm must pay more than $9,000 each to compensate the farm and the swine owners after voluntarily dismissing their suit, the Iowa Supreme Court ruled.The lower court didn't abuse its discretion in finding Michael Merrill's and Karen Jo Frescoln's claims frivolous, "even though reasonable people could see the matter differently," the high court said. A party who brings a frivolous claim "as part of a losing cause of action" against an animal feeding operation must pay its opponent's litigation costs and expenses under an Iowa law, according to the court. Attorneys' fees weren't at issue.
