California's move to require all new vehicles be zero-emission by 2035 could face legal headwinds. Crafting Regulations: Much depends on exactly how state officials write regulations to implement the governor's order, and how the D.C. Circuit decides pending litigation involving the California's authority to regulate auto emissions. Hard to Handicap: Legal challenges are certain, Case Western Reserve University law professor Jonathan H. Adler said, but "until we see what the precise contours of a [D.C. Circuit] ruling are, it's hard for me to handicap it." He added the state will have the "benefit of the judicial guidance" to craft a program more likely to withstand future challenges. Emily C.
