North Dakota landowners, many of whom eke out a living on land dotted with lakes and ponds called prairie potholes, may have no clear idea what problems await them under the new federal definition of jurisdiction of the Clean Water Act. The new definition of what constitutes "waters of the U.S." (WOTUS) that are subject to federal regulation is being challenged in court and may be defeated or even entirely rewritten by the incoming Trump administration. But for now, the Clean Water Rule clarifying WOTUS is complicating life for state regulators and could do so for landowners if federal courts allow it to take effect.
