A hazardous waste management company will face Superfund liability after the Northern District of California excluded the testimony of the company's expert witness regarding possible alternative sources of contamination (Dep't of Toxic Substances Control v. Technichem, Inc., 2016 BL 79249, N.D. Cal., No. 12-cv-05845, 3/15/16). The testimony of Technichem Inc.'s proposed expert that tetrachloroethylene (PCE) could have come from other sources is unreliable because his opinions are speculative and contain factual errors, the court said. The court found no evidence other than speculation linking any other source to the PCE contamination at the Technichem site. Technichem's business involved transporting, treating and disposing of dry-cleaning wastes containing PCE.
