Litigation over an Environmental Protection Agency rule that will require Texas utilities to invest about $2 billion to control emissions that affect visibility is expected to focus on how much flexibility states have under the Clean Air Act to craft their own regional haze plans. An attorney representing the power sector told federal lawmakers the court's eventual decision could help "set the tone" for state regional haze efforts going forward. However, a Sierra Club attorney predicted the court's decision wouldn't have strong implications for the viability of the haze program because the EPA clearly has authority to step in when a state fails to meet its regulatory requirements.
