A court in Pennsylvania has thrown out a lawsuit against environmental activists and township residents fighting to stop gas drilling in their township, ruling that the groups' actions against fracking amount to protected free speech (Dewey Homes v. Delaware Riverkeeper Network, Pa. Butler Co. C.P., No. 15-10393, Memorandum Opinion 5/25/16). The Delaware Riverkeeper Network, the Clean Air Council and five homeowners in Middlsex Township, Pa., who didn't want six unconventional gas wells drilled near their property were within their constitutional rights to challenge a township ordinance that allowed the drilling, Butler County Common Pleas Court Judge S. Michael Yeager said in a May 25 opinion.
