A pollution exclusion clause doesn't automatically free an insurer from its duty to defend a refrigeration company in an action stemming from an ammonia leak if that would exclude essential coverage, a federal court in Pennsylvania ruled (Scottsdale Ins. Co. v. Refrigeration Serv. & Eng'g, Inc., 2015 BL 101078, E.D. Pa., No. 14-cv-3920, 4/9/15). An issue of material fact exists as to whether a policy written by Scottsdale Insurance Company for Refrigeration, Service & Engineering Inc. was what the company bargained for, the U.S. District Court for the Eastern District of Pennsylvania said. The court April 9 denied Scottsdale's motion for summary judgment and allowed RSE to conduct discovery into the communications between Scottsdale, the broker and the underwriter that resulted in a policy it said "specifically excludes the very type of coverage it needs" as a heating, ventilating and air conditioning contractor.
