A federal appeals court has ruled the Environmental Protection Agency's regional haze regulations for Montana would arbitrarily require two coal-fired power plants to install pollution controls costing tens of millions of dollars without any assurance of visibility improvement (Nat'l Parks Conservation Ass'n v. EPA, 9th Cir., No. 12-73710, 6/9/15; PPL Montana LLC v. EPA, 9th Cir., No. 12-73757, 6/9/15). The U.S. Court of Appeals for the Ninth Circuit June 9 vacated portions of EPA's final rules setting emissions limits at the two plants-Colstrip Units 1 and 2 and Corette-and remanded to the EPA for further proceedings.
