A cleanup plan established in 2010 by the Environmental Protection Agency to reduce the amount of nutrients flowing into the Chesapeake Bay was upheld July 6 by a federal appeals court (Am. Farm Bureau Fed'n v. EPA, 2015 BL 214745, 3d Cir., No. 13-4079, 7/6/2015). The decision affirmed a district court decision issued in 2013. Under the cleanup plan, the EPA established total maximum daily load limits for nitrogen, phosphorus and sediment from Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia and the District of Columbia to reduce fouling of Chesapeake Bay waters.
