A tolling agreement between Asarco LLC and Union Pacific Railroad didn't waive the railroad's right to Superfund contribution protection after settling its liability with the government, the Eighth Circuit affirmed Aug. 8 (Asarco LLC v. Union Pac. R.R., 2014 BL 220076, 8th Cir., No. 13-2830, 8/8/14). The liability release obtained though settlement with the Environmental Protection Agency applies to all contribution claims related to the site, whether incurred before or after the consent decree's effective date, the U.S. Court of Appeals for the Eighth Circuit said in the Aug. 8 decision.
