Legislation signed by Delaware Gov. Jack Markell (D) Oct. 6 clarifies what lenders must do to maintain their liability protection under three Delaware environmental cleanup laws when they foreclose on or finance the redevelopment of a contaminated or potentially contaminated property. "To encourage lending institutions to support redevelopment of these sites, we need to ensure that they will not be punished for the pollution that they did not cause," Markell said in a statement. "It is the individuals and entities who contaminate our environment who should be held responsible for cleaning up their mess to the greatest extent possible."
