Two federal agencies are working to devise clearer rules on how and when they should estimate the impacts of federal actions such as oil drilling programs and land management plans on endangered species and their habitats. The "how" has to do with defining what is meant by the Endangered Species Act phrase "destruction or adverse modification" of critical habitat for a species. For several years, the NOAA Fisheries Service and the U.S. Fish and Wildlife Service, with shared authority under the Endangered Species Act, have been talking about coming up with a consistent definition of adverse modification that would reflect federal appeals court decisions.
