The Clean Air Act required the Environmental Protection Agency to regulate greenhouse gases emitted by cars and trucks after it determined those emissions posed a hazard to the public and the environment, the agency said in a court brief defending its tailpipe rule (Coalition for Responsible Regulation v. EPA, D.C. Cir., No. 10-1092, brief filed 9/1/11). In the brief filed Sept. 1 in the U.S. Court of Appeals for the District of Columbia Circuit, EPA said legal challenges to its greenhouse gas regulations for vehicles, issued under Section 202 of the Clean Air Act, do not address the emissions standards themselves.
