The Environmental Protection Agency has properly reviewed public comments on its proposed air toxics rule for power plants and intends to issue a final rule in November unless it is blocked by a federal court, an EPA official said Oct. 13. Janet McCabe, EPA deputy assistant administrator for air and radiation, said that although a lawsuit brought by an energy industry trade group asserts that EPA needs more time to respond to comments, "EPA's position is that it has had enough time to review all comments."
