Arch Coal Inc. asked a federal court April 2 to declare that the Environmental Protection Agency lacks authority under the Clean Water Act to revoke or veto the dredge-and-fill permit for the Spruce No. 1 mountaintop coal mine operated in southern West Virginia (Mingo Logan Coal Co. v. EPA, D.D.C., No. 1:10-cv-00541, 4/2/10.)rnThe permit, issued by the U.S. Army Corps of Engineers to the company's Mingo Logan Coal Co. subsidiary, allows rock and dirt to be dumped at sites that include streams after the corps has consulted with EPA. Section 404 (c) of the Clean Water Act allows EPA to exercise veto authority over a permit, but Arch Coal told the U.S. District Court for the District of Columbia that the veto authority can only be used while a permit is being considered, not after it has been issued, as in the case of Spruce No. 1.
