Ten farm and pesticide industry groups Nov. 2 petitioned the Supreme Court to restore an exemption for certain pesticide applications from a requirement to obtain Clean Water Act discharge permits (American Farm Bureau Federation v. Baykeeper, U.S., No. 09-547, 11/2/09; CropLife America v. Baykeeper, U.S., No. 09-533, 11/2/09).rnThe question for the court would be whether under the Clean Water Act, application of a pesticide for its intended purpose in accordance with federal pesticide regulation amounts to a "discharge of a pollutant" sufficient to require a permit.
