This note examines the judgement of the European Court of Justice in the case C-439/06 of "Citiworks AG vs. Sachsisches Staatsministerium fur Wirtschaft und Arbeit als Landesregulierungsbehorde" dated 22 May 2008 with regard to third party access. Reference will also be made to the main elements of the preceding opinion of Advocate General Mazak dated 13 December 2007. Flughaben Leipzig/Halle GmbH (hereafter "FLH") is the operator of the Leipzig/Halle airport (Germany). FLH manages an energy supply system through which itself (taking 85.4%) and 93 other undertakings located at the airport (taking 14.6%) are supplied with electricity. FLH itself is thus the main customer for electricity supplied through its system to this site. Citiworks AG (hereafter "Citiworks") supplied electricity to DFS Deutsche Voucher Flugsicherung GmbH, one of these 93 undertakings. On 12 July 2006, the regulatory authority of Saxony, decided that the energy supply system managed by FLH at Leipzig/Halle Airport was a so-called "site network" ("Objektnetz") within the meaning of Paragraph 110(1) of the German law on electricity and gas supply (the "Energiewirtschaftsge-setz", hereafter "EnWG").
