摘要

ISP copyright liability for copyright infringement over the internet is a now widely adopted approach for tackling extensive online copyright piracy in various jurisdictions. However, in China the inconsistent ISP knowledge standard in the existing legal framework was among the factors that impeded effective copyright law enforcement on the internet. With the passage of the Tort Liability Act of the PRC (the Tort Liability Act),~1 it is expected that the inconsistency of the ISP knowledge standard can be resolved and that the new Tort Liability Act will provide a clear guidance on how to evaluate ISPs' knowledge about copyright infringement and their liability upon such knowledge.
