1. Suppose a contract to carry goods by air from Singapore to Vienna and that the contract is regulated by one of the international air conventions. The relevant regimes are the Warsaw Convention 1929 (WC), the Hague Protocol of 1955 (HP), which amended the Convention of 1929, the Montreal Protocol No. 4 (MP4), and the Montreal Convention 1999 (MC) which came into force in 2003. For the purposes of this paper it matters little which regime applies. 2. In the event, the aircraft is unable to land at Vienna, and lands instead at Bratislava. The first possibility is that the goods go no further, and are sold there. The second is that they are moved from Bratislava to Vienna by an alternative mode of transport, likely to be by road. In that case, let us suppose that the cargo is unloaded from the aircraft in good order and condition and in the right quantity at Bratislava, however, on outturn in Vienna part of the cargo is found to be damaged, or missing and presumed stolen.
