The right of local governments to take private property for public use-a power guaranteed under the Constitution-is under scrutiny in the US, the result of alleged abuses of so-called eminent domain power. For the first time in 50 years, the US Supreme Court is reviewing a case involving eminent domain. In February it heard arguments in a case brought by property owners in New London, Connecticut, who objected to the city taking their homes as part of a proposed upscale development. And in California, state legislators will soon debate the merits of a proposed law making it harder for communities to use eminent domain to acquire private water utilities.
