The battle between Keystone Properties and the Jacksonville Port Authority (Jaxport) entered a new dimension October 11. Keystone filed a complaint in the United States District Court citing the provisions of a recently enacted federal eminent domain defense bill in its efforts to stop Jaxport front seizing a 65-acre tract of land it purchased on the port's waterfront. In its complaint, Keystone claims that any federal funds used by Jaxport to carry out the eminent domain process would violate the Bond Amendment. The Amendment, which was added to a Senate Appropriations bill in November 2005 by Senator Kit Bond (R) Missouri, is intended to soften the impact of the United States Supreme Court decision in Kelo vs. the City of New London, and protect private property rights.
