The executive branch has broad authority to redistribute military funds to build barriers along the southern border, attorneys for the Trump administration argued in a federal appeals court yesterday. A panel of judges for the 9th U.S. Circuit Court of Appeals yesterday explored whether the U.S. District Court for the Northern District of California was right to block President Trump's efforts to transfer $3.6 billion in military construction funds for the border wall — after Congress appropriated only $1.375 billion for the project. During oral arguments in Sierra Club v. Trump, the Justice Department argued that when the president declares a national emergency, he is permitted to redirect funding for military installations, such as a "base, camp, post, station, yard, center, or other activity under the jurisdiction of the Secretary of a military department." Judge Kim McLane Wardlaw asked DOJ attorney H. Thomas Byron III to spell out the limits of "other activity." "What in your mind would circumscribe that definition?" asked Wardlaw, a Clinton appointee. Byron said the funding provision was meant to be expansive, rather than limiting. Judge Daniel Collins questioned what relief the 9th Circuit could offer if it reversed the decision by the lower bench. After the district court issued an injunction blocking funding for the border wall, the Trump administration went to the Supreme Court, which thawed the funding freeze as the litigation progressed (Greenwire, July 29, 2019).
