Here’s a brief listing of what is new and what has changed in the HR COMPLIANCE LIBRARY: FLSA exemptions. The same Texas district court that issued a preliminary injunction against the U.S. Department of Labor (DOL) overtime rule last November followed up by granting a motion for expedited summary judgment, concluding that the entire final rule is invalid. The court noted that the rule makes overtime status depend predominately on a minimum salary level, thereby supplanting an analysis of job duties. By more than doubling the previous minimum salary level, the DOL effectively eliminated a consideration of whether an employee performs in a bona fide executive, administrative, or professional capacity.
