Signed into law on August 20, 1996, the Small Business Job Protection Act amended the FLSA to provide for an opportunity wage. Rather than paying the minimum wage, an employer may, in very limited circumstances pay a wage that is lower than the minimum wage. The opportunity wage:rn1 is set at not less than $4.25 an hourrn2 applies only to employees under the age of 20rn3 can be paid only for the first 90 consecutive calendar days of employment.
