Although the FLSA is primarily concerned with minimum and overtime wages, government enforcement officials view the statute as requiring the payment of contractual straight-time wages in excess of the minimum as a condition of satisfying the statutory overtime pay requirements (29 CFR 778.315-778.318).rnExample 1: Employee Walker is hired for $8.00 per hour; the maximum number of straight-time hours in the statutory workweek applicable to him is 40. In a particular week he works 44 hours. Pay at the statutory minimum wage rate for straight-time hours and at time and one-half the straight-time rate for overtime hours will not satisfy the FLSA overtime-pay requirements.
