Compensable hours worked under the FLSA often include time devoted to nonproductive as well as to productive activities. Overtime pay required by the statute must be computed on the basis of all compensable hours worked, both nonproductive and productive (29 CFR 778.318). Nonproductive time may be compensable by reason of the FLSA or by reason of the employment contract; nothing in the statute nullifies such a contract. Payment for breaks stacked at the end of the day do not alter employees' regular rates.rnLower rate for nonproductive time. If an employee is entitled to pay for nonproductive time-either by virtue of the FLSA or an employment contract-nothing prevents an agreement that the employee will be paid for such time at a rate lower than that applicable to productive work. In such a case, the regular rate and overtime pay are figured according to the rules applicable to two or more rates during one week.
