On April 29, the Labor Department released a new opinion letter finding that a service provider for a virtual marketplace company operating in the "on-demand" economy is not an employee of the company, but rather is an independent contractor under the FLSA. The opinion letter, FLSA2019-6, like all other opinion letters, is limited to the specific circumstances presented by the individual who, in this case, sought the opinion on behalf of a client, a virtual marketplace company that provides a referral service that connects service providers to end-market consumers to provide a wide variety of services.
