Although not judicially settled as yet, it would appear that currently spare parts are capable of being protected in Malaysia as copyright works and designs. The proposed amendments, however, will place automotive must-match spare parts squarely under the country's design law and exclude them from copyright law. If the current position does not provide for any exception to allow a right of repair, neither do the proposed amendments. The combined effect of the absence of any exception and the proposed longer duration of design protection of 25 years, which far exceeds the life span of most automobiles, will have an impact on competition in the spare-parts market and the interests of consumers. If the government's policy is to encourage the growth of the automotive-components industry, the question is whether that is the proper approach to take, particularly as the world is moving towards liberalisation of the spare-parts market, whether fully or partially.
