South Korea's Defense Acquisition Program Administration (DAPA) has filed a countersuit against BAE Systems and Raytheon demanding that the contractors pay a combined USD61 million in penalties related to the cancelled contract to upgrade 134 Republic of Korea Air Force Lockheed Martin F-16 Block 50/52 fighters. DAPA spokesman Kim Si-Cheol confirmed to IHS Jane's on 9 July that DAPA filed a suit with the Seoul Central District Court in June requesting BAE Systems pay USD43.25 million and Raytheon USD17.99 million for their failure to carry out the contract. The Foreign Military Sale was awarded to prime contractor BAE Systems in May 2014, but cancelled in early November due to what DAPA claimed at the time was an excessive price increase.
