A draft EU law to simplify the transfer of defence equipment between member states requires tighter reporting measures and should be complemented by binding rules on arms exports, say members of the European Parliament (MEPs). The European Commission unveiled proposals in December 2007 to promote an internal market in defence across the 27 countries. The package includes two draft laws. One proposes to throw open non-strategic defence procurement (in other words, all but nuclear weapons, encryption and other sensitive technology) to cross-border competition via new EU competition rules tailored for the sector. One of its main aims is to restrict use of Article 296: a provision in the EU's treaty that allows a member state to cloak a defence purchase from foreign competition.
