The International Criminal Court (ICC), the latest expression of the international community's struggle to regulate armed conflict, was born on 1 July amid wrangling over its powers and direction. This latest tool of international law has arrived at a time when the USA, facing unconventional attacks from its opponents, is increasingly seeking a unilateralist solution while questioning the ability of the laws of armed conflict to protect its citizens and prosecute those who attack it. As the laws of armed conflict seem to be honoured more in the breach than in the observance, does this branch of international law still have a place in modern armed conflict?
