If the Law of the Sea Convention was applied to space as it currently is, military and spy space satellites would not successfully fit within its framework. Defining space satellites as ships is problematic because ships require persons aboard them, and defining satellites as warships presents an immunity problem that allows for the unchecked destruction of enemy satellites. Additionally, defining satellites as warships could create an ASAT weapons arms race that might eventually create a powder keg for the next world war.
