Identifying Best Practices for Source Water Protection in Canada: A Comparison of Watershed Governance in Ontario, Alberta and B.C.

Source water protection planning is a watershed-level process which establishes land use policies to protect drinking water sources. Robust source water protection planning is necessary to ensure the integrity of drinking water threatened by increasing land scarcity and development pressure in Canada. This paper identifies best practices for source water protection by analyzing watershed governance in Ontario, Alberta, and British Columbia. It reviews the systems of each province, then compares and evaluates them based on modified indicators of good governance: clarity, use of law, adaptability, and civic participation. Ultimately, Ontario's Clean Water Act provides a model source water protection regime that has achieved binding protection plans for 80% of its residents. Extracting its core elements, an effective framework should focus on: (1) creating specific watershed management entities with prescribed compositions, (2) providing those groups with a defined planning process and mandate, and (3) granting plans a degree of legal effect. The paper concludes by theorizing how these elements might be incorporated into the existing structures of Alberta and British Columbia, specifically Alberta's Alberta Land Stewardship Act and Water for Life policy, and British Columbia's Water Sustainability Act.
