Following publication of the May 8, 2015, HM-251 final rule, Enhanced Tank Car Standards and Operational Controls for High-Hazard Flammable Trains, the Pipeline and Hazardous Materials Safety Administration (PHMSA) received a number of appeals requesting reconsideration of the provisions adopted therein. Six appeals were filed in the month after publication, one of which has been withdrawn, and others of which may well result in further rule-making action, either through adjustments to the final rule or initiation of a notice of proposed rulemaking. While we await PHMSA's response to the appeals, it should be of interest to review the issues raised. A summary of the provisions of the final rule appears below, followed by a review of the individual appeals.
