Protecting an individual's privacy is certainly a laudable goal. We should not be constantly harassed and followed by unwanted press attention. Yet, in California the problem of protecting individual privacy is compounded by a celebrity industry that thrives off public exposure. Determining the line between how the paparazzi are legally entitled to carry out its profession versus the privacy rights of celebrities is complex. Any person, including a celebrity, is certainly entitled to privacy for their spouses, children, and other family members on private property during private family moments. Yet, when the same group of individuals is in public at a family activity, where do paparazzi free press rights begin and end? Celebrities are public figures and do give up some of their privacy rights simply for remaining in the public eye. As discussed in this article, the press, including paparazzi, has a First Amendment right to pursue their photos and videos. Federal jurisprudence protects this right.
