Many potential stumbling blocks related to U.S. encryption controls-and the resulting consequences of being non-compliant with the EAR-can be avoided through strong compliance policies and procedures and employee training. Adoption of such compliance measures also demonstrates to the government that the company takes export controls compliance seriously, and that can be an additional substantial mitigating factor in the event of a potential violation.
