Online auction portals have recently been subjectrnto a wave of lawsuits around the globe. They werernsued by trademark owners for their involvement inrnthe sale of counterfeit goods by users. No matterrnwhat the respective legal outcome was, the decisionsrngave rise to substantial debates about the liability ofrninternet intermediaries and its implications for thernfurther development of Web 2.O. On the Europeanrnlevel, conflicting decisions have led to several referralsrnabout the interpretation of the E-Commerce Directivern(ECD).
