摘要

Evildoers use the Internet to spam, defraud, and violate intellectual property rights. For the sake of brevity, this article generally refers to all such persons as Internet miscreants. Counsel tasked with stopping these miscreants face two substantial problems. First, it is frequently very difficult to identify and locate them. Internet miscreants act through intermediaries. Any ordinary user accesses the Internet through their Internet service provider (ISP). This provides Internet users with a nominal anonymity. Likewise, domain name registrants maintain their domain name through their registrar, while spammers and others frequently shanghai computers for the purpose of carrying on their activities in an unaccountable fashion. (This article generally refers to all such parties as intermediaries.) In short, counsel rarely has a direct path to the miscreants but must follow an electronic trail to their quarry.
