Suing the Downloading Doe: Post-Verizon ISP Liability and Infringement Prosecution under the DMCA

Point. Click. Download. Although the simplicity of downloading music and other media files from the Internet has sparked a multibillion dollar industry of portable MP3 players and online music services, the decision in Recording Industry Association of America v. Verizon Internet Services and the closely following Recording Industry of America v. Charter Communications, Inc., has those who download and share media files illegally less confident about the likelihood of remaining anonymous and their illicit activities being unpunished. While the Verizon and Charter decisions narrowed the scope of ISP liabilities under § 512 of the the Digital Millennium Copyright Act (DMCA), they have also changed the way in which those seeking copyright protections under the DMCA go about finding the identities of those who infringed their works through the use of John Doe suits.
