摘要

Federal courts always exercise federal preemption of state laws with the utmost attention to preserving the integrity of federalism. This is especially true when dealing with established commercial practices that have sought and found justification under state law. When contract practices have intersected with express or implied federal intellectual property policy, the courts have scrambled to find an equitable result. Although most courts have validated the shrinkwrap license, which protections touch on intellectual property rights, a recent dissent in a Federal Circuit case has once again prompted thoughtful consideration of this dilemma.
