The lack of any effective national legislation regulating UCE has led to the adoption of inconsistent and sometimes conflicting state law. Until comprehensive federal legislation is adopted, parties seeking to advertise or otherwise communicate through mass email run the risk of significant civil, and potentially criminal, liability.
