摘要

The IOPCF is an evolving international organism and its instruments continue to develop in order to better attain its objectives. The greatest challenge is to accomplish this in an atmosphere of compromise in order to satisfy convergent interests of State Parties. So far this has been achieved successfully. Certain criticism of the system expressed by the authors of the cited article, especially in respect the channelling of liability to the shipowner and financial limits of liability of all the stakeholders, is justified but not easily reconcilable with the idea of compromise and preservation of the unity of the system. So far, the various attempts to reassess the rules have not resulted in much progress. Nevertheless, one can expect that similar attempts will continue to be made and that the Funds will continue to evolve. It will to be an interesting process to observe.
