"With only the hardest and most costly technical solutions left, the industry will strenuously resist adopting them." Nevertheless, the EPA does not seem to be relenting in its drive for clean diesel engine emissions. It is arguable whether such extreme regulation is completely necessary. After all, with the exception of the incident where manufacturers used devious methods to circumvent the rules, diesel engine manufacturers have been attempting to comply with new EPA regulations enacted virtually every year throughout the 1990's. Additionally there has been considerable success in clean- ing up the air, as current emissions contain only 10% of the most dangerous pollutants that were present in 1998. The debate comes back to the clash between the environment and economics. Air that is 100% clean necessarily leads to a huge financial impact, unless a trade off of a bit less clean air can be made for vast economic savings. Congress authorized the EPA to consider costs when regulating, but did the Administrator adequately do that in this situation? The D.C. Circuit seems to think so. And, at least for now, that is the only opinion that really matters.
