The New Jersey Department of Transportation (DOT) contends that the New Jersey Spill Compensation Act bars liability against the department because it involuntarily acquired property for highway construction from which contaminated soil was taken in Hamilton Township. The case is in federal court for the District of New Jersey. Third-party defendants Stanbery Hamilton LLC and Stanbery Development LLC contend NJDOT knew or should have known where hazardous substances were present on its property and breached its duty to Stanbery to disclose a potentially hazardous condition on its property.
